  • Removal Proceedings Terminated Removal Proceedings

    Client is a native and citizen of Cuba. He became a legal permanent resident in the United States in 1996. In 1999, Client was arrested and convicted of Possession of Cocaine in Miami for allegedly possession a small bag of cocaine in a bar. Client was represented by another attorney for that case and pled guilty. Client then led a good life in the United States for almost two decades until he left the United States on a trip in 2019. Upon his return, Client was detained and placed in removal proceedings based on his 1999 cocaine conviction. After hiring Hubbs Law, attorney E.J. Hubbs was able to successfully vacate the prior conviction and persuade the State to dismiss the charge. Erika Hubbs then successfully terminated his removal proceedings since there was no longer a basis for the removal.

  • Dismissed Public Assistance Fraud

    Client retained Hubbs Law during the Department of Children and Family’s investigation into Client for public assistance fraud. Attorney E.J. Hubbs advised Client during the entire investigation which took close to a year. Ultimately, Client was charged. However, E.J. was able to negotiate Client’s entry into the PTI program eventually leading to the dismissal of Client’s case.

  • Citizenship Approved Naturalization

    Client was born in Honduras and adjusted status to Legal Permanent Resident in 2016. Client resides in Florida and has to travel often for work. Client hired Erika in September 2022, to prepare his application. Three months later, he was approved for citizenship. His naturalization certification was issued in January 2023.

  • Dismissed Aggravated Battery (Great Bodily Harm)

    Client was charged with Aggravated Battery (Great Bodily Harm) after being involved in a physical altercation with an individual in Walgreens while he was shopping with his girlfriend. The other party and Client had a verbal argument in Walgreens that continued outside. Eventually, the verbal argument turned physical and ended with Client using a taser on the other party. The other party then fell into a vehicle dislocating his shoulder. At the beginning of the case, the State and alleged victim insisted on Client pleading guilty to a felony. However, after investigating the case, attorney E.J. Hubbs filed a Stand Your Ground Motion to Dismiss and the State changed their offer to PTI which Client completed successfully. The case was then dismissed.

  • Approved Adjustment of Status through Marriage

    Client is a native and citizen of India. He came to the U.S. in 2019 on a F-1 Visa. He married his U.S. citizen boyfriend in 2022. Client hired Erika to file all of the necessary proof of a bona fide, same-sex marriage. His application was filed on September 2022 and USCIS requested more evidence pertaining to the U.S. spouse’s ability to financially support his spouse. Erika was able to use Client’s income, in addition to his spouse’s income, to prove adequate means of financial support. The application was approved in June 2023.

  • Motion to Vacate Granted – Case Dismissed Possession of Cocaine

    Client was charged and convicted of Possession of Cocaine in 1999 for allegedly possessing a small bag of cocaine in a bar. Client then sealed the charge and thought the case was behind him. However, in 2019, Client was placed in removal proceedings after returning from a trip outside the United States. The government was trying to deport him from the United States based on the only conviction on his record – Possession of Cocaine. Prior to his first court date in Immigration Court, Client hired Hubbs Law to attempt to vacate his Cocaine conviction. Attorney E.J. Hubbs was able to persuade the State to agree to vacate Client’s plea and dismiss the case. Then, attorney Erika Hubbs was able to terminate Client’s removal proceedings because there was no longer a basis to deport Client since the cocaine charge was dismissed.

  • Granted Motion to Reopen

    Client is a native and citizen of Jamaica. He came to the U.S. in 2017 on a tourist visa. In 2019, the government placed Client in removal proceedings by mailing a notice to appear and a notice of hearing to Client’s address in New York. Client never received the notices and failed to appear in court for her immigration hearing. This resulted in Client being removed to Jamaica in absentia. Upon discovering the removal order, Client hired Hubbs Law to file a motion to reopen her removal proceedings because she was unaware of her prior court date. Attorney Erika Hubbs filed a motion to reopen and submitted evidence that she was not living at the address where the court documents were sent. This resulted in the Court granting Erika’s motion to reopen which removed Client’s deportation order. Erika was then able to assist Client in getting her green card and she is now a legal permanent resident.

    Client is a native and citizen of Guatemala. He came to the U.S. in 2005 without inspection. There, he married his wife and had four children. In 2015, he was taken into custody by ICE after being arrested for a No Valid Driver’s License. Client hired Hubbs Law to represent him. Attorney E.J. Hubbs filed an application with the court for 42B Cancellation of Removal. At the individual hearing, the Judge found that Client met his burden of proving 10 years of continuous presence and good moral character. However, she found that Client did not prove hardship and Client was ordered removed to Guatemala. However, in 2024, Erika Hubbs filed a Motion to Reopen with the BIA arguing new evidence had developed in Client’s case. Specifically, Client’s wife developed a large brain hemorrhage and aneurysm. Erika argued to the BIA that this new evidence created additional evidence of hardship that the Court should consider and asked to reopen the case. The BIA agreed and the case is now reopened.

  • Terminated & Approved Removal Proceedings & Adjustment of Status Through Marriage

    Client is a native and citizen of Turkey. He came to the U.S. in 2016 on a J-1 visa. After entering the United States, Client met and married a United States citizen. He applied to adjust status to a legal permanent resident in 2017. However, USCIS administratively closed his case because Client was placed in removal proceedings due to an arrest for Tampering with a Witness. Once in removal proceedings, Client hired Hubbs Law. Attorney E.J. Hubbs knew the biggest hurdle to overcome in the case would be the felony charge. However, E.J. was able to file a request for prosecutorial discretion and successfully argued that the government should terminate removal proceedings in light of Client’s lack of other criminal record, rehabilitation, marriage to a United States citizen, and employment history. After the removal case was terminated, attorney Erika Hubbs then diligently prepared Client’s adjustment of status application with USCIS and submitted evidence related to Client’s bona fide marriage and his good moral character. After two interviews, USCIS granted Client’s application and he now has a green card.
